Anomali Peraturan Presiden Nomor 113 tahun 2021 tentang Struktur dan Penyelenggaraan Bank Tanah Ditinjau dari Putusan Mahkamah Konstitusi Nomor 91/PUU-XVIII/2020 tentang Pengujian Formil UU Cipta Kerja

Mahkamah Konstitusi sebagai pemangku kekuasaan kehakiman di Indonesia memang dilengkapi keistimewaan tertentu, salah satunya putusan Mahkamah Konstitusi bersifat final dan mengikat. Namun, pada faktanya terdapat pembangkangan pada putusan Mahkamah Konstitusional, terbaru Putusan Mahkamah Konstitusi Nomor 91/PUU-XVIII/2020 tentang Pengujian Formil UU Cipta Kerja mendapat pembangkangan dari Presiden di mana seharusnya Presiden dilarang mengeluarkan Peraturan Presiden, namun masih tetap saja Presiden mengeluarkan Peraturan Presiden Nomor 113 Tahun 2021 tentang Struktur dan Penyelenggaraan Bank Tanah . Rumusan yang akan dijawab dalam penelitian ini adalah bagaimana status Peraturan Presiden Nomor 113 Tahun 2021 tentang Struktur dan Penyelenggaraan Bank Tanah bila ditinjau dari Putusan Mahkamah Konstitusi Nomor 91/PUU-XVIII/2020 tentang Pengujian Formil Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja terhadap Undang-Undang Dasar 1945. Penelitian ini adalah penelitian yurids-normatif, untuk mengadakan penelusuran berkaitan dengan peraturan perundang-undangan. Ketidakpatuhan pada putusan Mahkamah Konstitusi harus ditanggapi secara serius, karena hal ini menyangkut nama baik Mahkamah Konstitusi sebagai penjaga konstitusi (the guardian of constitution).

Abstract

The Constitutional Court as a judicial authority in Indonesia is indeed equipped with certain privileges, one of which is the constitutional court's decision is final and binding. However, there is defiance in the constitutional court's decision, the latest Constitutional Court Decision No. 91 / PUU-XVIII / 2020 on Testing Formal Work Copyright Law received defiance from the President where the President should be prohibited from issuing Presidential Regulations, but still, the President issued Presidential Regulation No. 113 of 2021 on the Structure and Implementation of Land Banks. The formula that will be answered in this study is how the status of Presidential Regulation No. 113 of 2021 on the Structure and Implementation of Land Banks when viewed from the Constitutional Court Decision No. 91 / PUU-XVIII / 2020 on Formil Testing Law No. 11 of 2020 on Work Copyright against the 1945 Constitution. This research is a juried-normative study, to conduct a search related to the laws and regulations. Non-compliance with the constitutional court's decision must be taken seriously because it concerns the good name of the Constitutional Court as the guardian of the constitution.
