ANALISIS DAN EVALUASI PERATURAN PERUNDANG-UNDANGAN DARI PERSPEKTIF PERLINDUNGAN LINGKUNGAN
Abstract
Berbagai penelitian menunjukan ada persoalan mengenai kualitas peraturan perundang-undangan di Indonesia, khususnya yang berkaitan dengan lingkungan dan sumber daya alam. Tulisan ini mendiskusikan bagaimana melakukan analisis dan evaluasi terhadap peraturan perundang-undangan untuk mengembangkan peraturan perundang-undangan yang berkualitas di Indonesia, khususnya dari perspektif perlindungan lingkungan. Untuk itu, penelitian ini utamanya mengacu pada literatur legisprudensi (legisprudence) yaitu literatur yang mengkaji peraturan perundang-undangan dari perspektif teoritis dan praktis, dan juga berbagai materi yang terkait dengan peraturan perundang-undangan. Berdasarkan penelurusan literatur tersebut disimpulkan bahwa analisis peraturan perundang-undangan dibagi menjadi dua tahap yaitu yang dilakukan sebelum pengesahan peraturan perundang undangan atau ex ante, serta analisis dan evaluasi peraturan perundang-undangan yang dilakukan setelah peraturan perundang-undangan dilaksanakan atau ex post. Tulisan ini menawarkan kriteria dan cara melakukan analisis ex ante dan dan ex post berdasarkan perspektif perlindungan lingkungan. Namun sesungguhnya kriteria dan tehnik analisis dan evaluasi harus disesuaikan dengan jenis, isi dan tujuan dari peraturan perundang-undangan serta kondisi yang dihadapi pada wilayah pengaturan peraturan perundang-undangan tersebut. Pada akhirnya tulisan ini menyimpulkan bahwa penelitian mengenai kriteria, metode, tehnik dan alat analisis dan evaluasi peraturan perundang-undangan perlu sebanyak mungkin dilakukan untuk mendorong pembentukan peraturan perundang-undangan yang lebih baik.
